Requirements to request parental authority
Parental authority, in Argentina called parental responsibility since the new civil and commercial code came into force, are the rights and obligations that parents have with respect to their child, a minor. Parental responsibility is not lost, except in particular cases such as a person deprived of their liberty, that is, a parent who is in prison. In cases where a child is neglected by the other parent, personal care can be requested and conditions set for said care. It is important to note that a parent cannot be forced to see their child, but they can be forced to allocate part of their money to the maintenance and effective development of the minor.
What is parental alienation?
For the Inter-American Court of Human Rights, parental alienation consists of conduct carried out by one of the parents, especially the one who has the preference for personal care in order to avoid communication or visits from the other parent. These behaviors affect the child's decision-making and awareness of the parent who cannot share time and recreation, leading in the extreme case to emotional disengagement.
